In the present petition, the grievance of the petitioner is that in June, 2022, the petitioner had filled a registration form under the Registration ID #1153499 wherein, the petitioner has mentioned that he is interested in group 'C' & 'D' posts, where the category was General and no disability was mentioned and the petitioner duly appeared for the group 'C' post under the said registration ID i.e. #1153499. Thereafter, in the month of June, 2023, the petitioner again applied for group 'D' post under the registration ID # 1852515 by attaching the Bench Marked Disability Certificate but the respondents have not treated his disability certificate as a valid one by relying upon the earlier registration of the petitioner, which is totally arbitrary especially when the respondents themselves had given an opportunity to the petitioner to apply for a fresh application hence, as per the fresh application having registration ID #1852515, the petitioner is to be given consideration for Group 'D' post.

CWP No. 24910-2023 -22023:PHHC:140773 Haryana, accepts notice on behalf of the respondents-State and submits that the petitioner had filled two forms one in June, 2022 against Group 'C' & 'D' posts and another in June, 2023 for Group 'D' post only having different registration numbers and in the subsequent form, the petitioner had claimed disability whereas, he has not complied with the other conditions required to fill up the said form, hence, his initial form has been taken as a valid form for consideration against Group 'D' post and in case, any grievance is raised by the petitioner against the said action, he may file appropriate representation before the authorities concerned and in case, any representation is filed by the petitioner, the same will be decided in accordance with law within a period of two weeks from the receipt of any such representation by passing an appropriate speaking order. 4.

Learned counsel for the petitioner submits that keeping in view the statement of learned counsel for the respondents, the present petition may kindly be disposed of having been not pressed any further with liberty to the petitioner to file appropriate representation for the consideration of the respondents that the petitioner is entitled for consideration of his claim for Group 'D' post as per the registration ID #1852515 including the nondeposit of the requisite fee for filling-up the second form. 5.
