Learned counsel for respondent No.1 submits that as per the order dated 07.11.2023 even if the ACR of the petitioner for the year 201920 is not taken into consideration to evaluate the overall performance and a HARSHA RANI 2025.09.03 18:02 I attest to the accuracy and integrity of this document

CM-9154-CWP-2025 in/and CWP-25101-2023 previous ACR of the year 2016 was taken into consideration and an appropriate order has already been passed on 07.02.2024 (Annexure R-1) that still, as the petitioner was far below the merit cut off hence, the petitioner does not make it to the grade for promotion. 2.

Probably, keeping in view the said fact, the petitioner might not be interested in pursuing the present remedy as no one appeared on behalf of the petitioner on the last date of hearing and today again. 3.

Dismissed for non-prosecution.
