The petitioner filed petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing of FIR No.440, dated 02.08.2021, registered under Section 420 IPC (later Sections 471, 473, 417 and 201 IPC were added and Section 420 IPC was deleted) registered at Police Station Sector-32-33, Karnal, District Karnal, Haryana, and all the subsequent proceedings arising there-from, qua the petitioner, in light of compromise deed dated 01.10.2024 effected between the parties (Annexure P-2).

Vide order dated 22.10.2024, the parties were directed to appear before the Illaqa/Duty Magistrate to record their statements qua the compromise and the Court was directed to send the copies of the same to this Court.

In compliance of the order dated 22.10.2024, learned JMIC, Karnal had sent its report dated 11.12.2024, wherein it is submitted that neither the accused nor the complainant appeared for recording their MOHIT 2025.10.31 16:30 I attest to the accuracy and integrity of this document

CRM-M-52545-2024 (O&M) -2statements. Since then, none has appeared on behalf of the petitioner as well as respondent No.2. Furthermore, as per report, one accused person namelyMahender Soni has been declared proclaimed person. 4.

On previous two occasions, none has appeared on behalf of the parties. Today as well, the case was passed over twice, but none has put in appearance for either of the parties. It seems that they are not willing continue with the proceedings. Consequently, the present petition is dismissed for non-prosecution.
