The present civil revision has been filed under Article 227 of the Constitution of India for quashing the impugned order dated 12.08.2025 (Annexure P-2), whereby the learned Executing Court has issued sale warrants of the demised house, which is the only single residential house meant for the residence of the entire family of the petitioners, allegedly in violation of the provisions of Section 60(ccc) CPC as well as Section 34 of the SARFAESI Act.

Learned counsel for the petitioners has furnished a chart showing the remaining amount payable by the petitioners, which comes to ₹4,74,344.79/-. He further submits that the petitioners are poor persons and the sole breadwinner of their families and, accordingly, prays that the petitioners may be permitted to make the payment as per the said chart. It is also prayed that, till such time, the operation of the impugned order dated SHUBHAM 2025.09.11 17:45 I attest to the accuracy and authenticity of this document/order

CR-6192-2025 12.08.2025 (Annexure P-2) passed by the learned Executing Court, be stayed.

In view of the aforesaid submissions and considering the financial condition of the petitioners, the present petition is disposed of with a direction that the petitioners shall make the payment strictly as per the chart furnished by them. Till such payment is made, the operation of the impugned order dated 12.08.2025 (Annexure P-2) shall remain stayed. 4.

Learned counsel for the petitioners is directed to submit the aforesaid chart before the learned Executing Court for necessary reference and compliance.
