* * * * RAVI SHANKER JHA, C.J. (ORAL) This is an application under Section 11(6) of the Arbitration and Conciliation Act, 1996 (in short the Act) for the appointment of an arbitrator.

The necessary declaration under Section 12(5) of the Act, as sought from Justice Mukul Mudgal, former Chief Justice of this Court, vide order dated 04.08.2023, has been received and is placed on record. At this stage, learned counsel for the parties conjointly submit that the arbitration proceedings shall commence only after the applicant makes the necessary security deposit. Conjoint statement of the learned counsel for the parties to this effect is taken on record. Learned counsel for the parties further submit that in view of the previous order dated 04.08.2023 passed by this Court, Justice Mukul Mudgal, former Chief Justice of this Court, may be appointed as an arbitrator.

In the circumstances, Justice Mukul Mudgal, former Chief Justice of this Court, is appointed as an arbitrator to adjudicate upon the disputes and differences between the parties. The application is, accordingly, disposed of.
