RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of direction to official respondents to take action against respondents No.6 to 9 on the complaint, Annexure P-1, in accordance with the provisions of Section 20/216 of the Punjab Panchayati Raj Act, 1994, as the same has not been taken despite the fact that respondent No.3 vide its report dated 28.06.2021, Annexure P-3, and respondent No.4 vide its inquiry report dated 12.12.2022, Annexure P-7, have already recommended to take action against the private respondents but despite that, no action has been taken in spite of several reminders.

It has been contended by learned counsel for the petitioner that inquiry against respondents No.6 to 9 was carried out by the Additional Deputy Commissioner (D), Tarn Taran, and the action was recommended to be taken against them by him vide its letter dated 28.06.2021, Annexure P-3. He further submits that respondent No.4, i.e. District Development and Panchayat Officer, Tarn Taran, had also recommended for suspension of MEENU 2023.11.08 12:51 I attest to the accuracy and integrity of this order/judgment

CWP-25079-2023 -2Panahcyat Secretary, Block Tarn Taran vide its order dated 12.12.2022 and despite that the Director has not taken any action on the same. Notice of motion.

On the asking of the Court, Ms.Akshita Chauhan, Deputy Advocate General, Punjab, who is present in Court, accepts notice on behalf of the respondents/State and has submitted that action has already been initiated, however, the same is pending consideration before respondent No.2, i.e. the Director, Rural Development and Panchayats. In view of the submissions made by learned State counsel, it is apparent that though the action has been initiated by respondent No.2, (Director), however, the same is not concluded so far. Hence, respondent No.2, i.e. Director, Rural Development and Panchayats, Govt. of Punjab, is directed to conclude the proceedings expeditiously in accordance with law preferably within three months from today.
