Application is allowed as prayed for.

Main case:

Through the instant petition under Section 438 Cr.P.C., the petitioner seeks anticipatory bail in case FIR No. 267 dated 20.12.2021 registered under Sections 307, 341, 427, 506, 148, 149 IPC and Sections 25, 27 of the Arms Act, at Police Station Goindwal, District Tarn Taran. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case; that the allegation against the petitioner and other co-accused are that they were armed with pistols, fired upon the complainant; that it is a case of version and cross version; that the MANGAL SINGH 2022.12.23 06:06 I attest to the accuracy and authenticity of this order/judgment.

 

 

    present FIR has been registered against the petitioner due to political rivalry; that in the present case, the petitioner and co-accused have received the injuries entailing the offence under Section 307 IPC; and that co-accused has already been granted the concession of anticipatory bail. I have heard the learned counsel for the parties and have also gone through the documents on record.

Perusal of order dated 16.09.2022 passed by the learned Additional Sessions Judge, Tarn Taran, would itself reveal that the petitioner was armed with a pistol and gun-shot was also fired. The allegation against the petitioner is that he fired gun-shot towards the complainant with an intention to kill him, which hit on the right side of the waist of the complainant.

Considering the seriousness of the allegations against the petitioner, the custodial interrogation of the petitioner is necessary. Hence, the petitioner does not deserve the concession of anticipatory bail. In view of the above, the present petition is dismissed.
