This is a revision petition under Article 227 of the Constitution of India for setting aside the order dated 23.07.2024 (Annexure P-1) passed by learned Civil Judge (Junior Division), Ludhiana, vide which the application under Order VII Rule 11 CPC filed by the petitioner has been dismissed.

On 31.07.2025, the trial Court had passed the following order: "M/S SUKHMANI INDUSTRIES Vs HDB Financial Service Ltd

Present:

Sh. J.S. Grewal, Advocate for the plaintiff Sh. Sachin Seth, Advocate for defendants No. 1 to 3 Defendant No. 4 exparte At this stage, Gursimran Singh, Legal Officer of HDB Financial Services Ltd., Mall Road appeared and suffered a statement that the defendant company has taken over the possession of the property in dispute and has sold the PUNEET SACHDEVA 2025.11.19 14:27 I attest to the accuracy and authenticity of this document Chandigarh

CR No.6188 of 2024 same in auction. Now, nothing is due towards the plaintiff company. That I undertake to withdraw the writ petition before Hon'ble Punjab and Haryana High Court on behalf of defendant company. The defendant company will not file any kind of litigation against the defendant qua the present loan account in future.

Sh. Bhupinder Singh, proprietor of M/s Sukhmani Industries also suffered a statement that he has heard the statement of authorized legal representative of the defendant company which is true and correct. On the basis of the statement, he has withdraw the suit and prayed that same be dismissed as withdrawn.

Heard. In view of the statement made today by proprietor of M/s Sukhmani Industries, the present suit filed by plaintiff dismissed as withdrawn. File be consigned to Record Room after due completion in all respects. Pronounced:

In view of the same, the present petition has been rendered infructuous.
