*** Amol Rattan Singh, J. (Oral) By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of 'regular bail'. A quantity of 1 Kg and 70 gms of opium, as is stated to have been recovered from the petitioner (as per the case of the prosecution), being below commercial quantity, with him having remained in custody for almost four months, with the trial to still effectively commence, and with no prosecution witnesses having been examined so far, I deem it appropriate to admit the petitioner to bail during the pendency of the trial. Consequently, without making any comment on the actual merits of the case, for or against the petitioner, this petition is allowed.
