(Oral) The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/1351/2025, titled 'Amulya Yadav Vs. Chandni', filed by the respondent-husband, pending in the Family Court, Jalandhar and she seeks transfer of the same to the Court of competent jurisdiction at Fatehgarh Sahib.
Upon notice issued, the respondent did not make appearance, despite service and as such, was proceeded against ex parte. Counsel for the applicant heard.
It is submitted that on account the matrimonial dispute, the parties are residing separate. There is no child born from the said wedlock. The applicant is not having any source of earning. The distance between the SONU 2026.02.16 09:14 I attest to the accuracy and authenticity of this document
TA-1139-2025 two places is stated to be about 123 kms. Otherwise also, the petition under Section 125 Cr.P.C., filed at the instance of the applicant, is pending in the Courts at Fatehgarh Sahib, wherein the respondent is already making appearance.
In view of the aforesaid fact situation, more particularly, considering the fact of the applicant, not having any source of earning; fact of another litigation, arising from the estranged marriage, already pending in the Courts at Fatehgarh Sahib, which is being pursued by the respondent and above it, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/1351/2025, titled 'Amulya Yadav Vs. Chandni', filed by the respondent-husband, stands transferred from the Family Court, Jalandhar, to the Court of competent jurisdiction at Fatehgarh Sahib. The requisite record of the aforesaid case be sent by the Family Court, Jalandhar, to the District and Sessions Judge, Fatehgarh Sahib.
Learned District and Sessions Judge, Fatehgarh Sahib, shall assign the said petition to the Family Court, Fatehgarh Sahib. Even, the parties are directed to appear before the Family Court, Fatehgarh Sahib, within a period of one month from today onwards.
