The petitioner through instant petition under Article 226 of Constitution of India is seeking setting aside of order dated 27.03.2023 (Annexure P-2) whereby respondent initiated departmental proceedings against the petitioner.

Learned counsel for the petitioner contends that FIR No. 02 dated 29.03.2022 under Section 7 of the Prevention of Corruption Act, 1988 has been registered against the petitioner and on the same set of allegations the respondent department has initiated departmental proceedings. If the petitioner reveals his evidence during departmental proceedings, it would hamper his defence before the trial court.

Mr. Inderpreet Singh Kang, AAG., Punjab who on advnace notice is present in Court and submits that there are few witnesses which are common in departmental and criminal proceedings and departmental proceedings with ARCHANA ARORA 2023.11.06 18:08 I attest to the accuracy and integrity of this order/judgment
