 Custody certified filed on behalf of the respondent-State of Punjab is taken on record.

The petitioner is in custody since last about one year eleven months for an offence punishable under the Narcotic Drugs and Psychotropic Substances Act, 1985 ( for short 'NDPS Act') where 2 kg of Heroine was recovered from the possession of the petitioner. 3.

Learned State counsel submits that there is another offence under the NDPS Act registered against the petitioner which was registered on 15.03.2024. Looking to the quantity of the narcotic drug seized and the fact that only four witnesses are left to be examined before the trial Court, it would be appropriate to await the conclusion of recording of the remaining prosecution witnesses.

It is also informed by learned counsel for the petitioner that seizure witnesses have not yet been completely examined as their cross examination has been deferred.

Looking to the aforesaid circumstances, it would be appropriate that remaining prosecution witnesses are allowed to be examined before considering the request for grant of bail.
