The present petition has been filed under Section 439(2) of the Code of Criminal Procedure for cancellation of bail granted to respondent No.2 vide order dated 19.09.2023 in case FIR No.54 dated 11.08.2023, under Sections 498-A, 420, 417 of the Indian Penal Code, 1860 registered at Police Station Women Ludhiana, District Ludhiana. 2.

Vide order dated 09.11.2023, this Court granted time to learned counsel for the petitioner to place on record a copy of order vide which interim bail was granted to respondent No.2.

Pursuant to order dated 09.11.2023, learned counsel for the petitioner has filed CRM No.50103 of 2023 to place on record the order dated 12.09.2023. For the reasons mentioned in the application, the same is allowed and order dated 12.09.2023 is taken on record as Annexure P-6. 4.

In view of the above, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file an appropriate application before the Court of Sessions, which granted the interim bail to respondent No.2.

The present petition is accordingly dismissed as withdrawn with the aforesaid liberty.
