**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 91 dated 16.8.2019 under Sections 115/120-B IPC and Section 21, 22, 29 and 30 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Khalchian, District Amritsar.

Learned counsel for the petitioner submits that in the present case, initially Balkar Singh was arrested and recovery was effected form him and in his disclosure statement, he named Gulzar Singh. Thereafter Gulzar Singh was also arrested and recovery was effected from him. Gulzar Singh further suffered a disclosure statement in which he named the petitioner. Learned counsel further submits that the petitioner has not been named in the FIR and he has been in custody since 23.8.2019. Learned State counsel, on instructions from ASI Narinder Singh, submits that recovery was effected from the petitioner. CRM-M No. 51016 of 2019 -2is yet to be presented. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
