**** Manjari Nehru Kaul, J.(Oral) In compliance of order dated 22.10.2024, learned counsel for the petitioner has placed on record the copy of the air tickets of the petitioner qua his intended travel to India. Same is taken on record subject to all just exceptions. As per the air tickets placed on record, the petitioner is due to arrive at Delhi in India on 27.10.2024. Instant petition has been filed under Section 528 of BNSS for quashing of the order dated 24.04.2024 (Annexure P-1) passed by SDJM, Zira, District Ferozepur vide which the petitioner has been declared a proclaimed offender in case bearing No.COMI-76-2017. 2.

Learned counsel for the petitioner submits that the petitioner was abroad when the summoning order dated 20.07.2023 was passed and he was not aware about the said summoning order and as a result thereof, learned trial Court on 15.01.2024 issued nonbailable warrants to secure his presence. On the asking of Court, Mr. Navdeep Singh, DAG, Punjab accepts notice on behalf of the respondent-State. 5.

In view of the submissions made above, the petition is disposed of with directions to the petitioner to appear and surrender before the trial Court within a period of seven days from 27.10.2024. Till then, no coercive steps be taken against the petitioner. It is, however, made clear that in case, the petitioner fails to surrender before the Court below on or before 04.11.2024, then this order shall be of no avail to him.
