The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.84 dated 13.12.2018 registered under Sections 376 IPC at Police Station Kahnuwan, District Gurdaspur.

By an order dated 09.01.2019 while referring the matter to Mediation and Conciliation Centre of this Court, this Court had directed that no coercive means shall be adopted against the petitioner. 3.
Learned counsel appearing on behalf of the petitioner submits that petitioner and prosecutrix have solemnized marriage and out of the wedlock, a son has born, while further contending that a petition has been preferred separately for quashing of the FIR. 4.
Learned counsel appearing for the State on instructions from IO does not dispute the factum of marriage between the petitioner and the prosecutrix.
