SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Articles 226/227 of the Constitution of India for issuance of writ in the nature of certiorari for quashing the impugned office letter dated 15.09.2023 (Annexure P-9), issued by respondent No.3 and promotion policy issued vide notification dated 10.03.2005 (Annexure P-10) in respect of Ministerial Service Head Office Cadre for clerical staff and directing the respondents to promote the petitioner on the post of Lower Divisional Clerk from the post of peon.

After arguing for some time, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to pursue the relief in the light of Annexure P-4, wherein the higher authorities have simply referred the case back to XEN for making a fresh proposal after examining the policies as applicable to the case of the petitioner.

After having heard Mr. Mohnish Sharma, Advocate, this Court is of the prima facie view at this stage that the present petition is totally premature and unwarranted.
