RAMENDRA JAIN, J. (ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Sanjay in a case arising from FIR No.205 dated 18.05.2019 registered under Sections 420 and 406 IPC at Police Station Urban Estate, District Rohtak. According to the prosecution, petitioner sold two gold bricks to the complainant for a sum of `27.00 lakh. On getting checked those bricks, same were found fake. On arrest, entire sale consideration of `27.00 lakh was recovered from the petitioner.

Learned counsel for the petitioner inter alia contends that petitioner is in custody since 20.05.2019. He has been falsely implicated. Conclusion of trial may take sufficient long time inasmuch as prosecution has not concluded the evidence despite availing eight effective opportunities. No useful purpose would be served by detaining the petitioner in jail any more.

-2CRM-M-50247 of 2019 On the other hand, learned State counsel vehemently opposed grant of bail to the petitioner.

Recovery of `27.00 lakh in cash from the petitioner proves his complicity in commission of crime beyond any shadow of doubt. That apart in this second bail application, no new circumstance has been shown to grant bail to the petitioner.

Perusal of file shows that during 8/9 months of his arrest, petitioner has moved six successive applications for bail i.e. four before the trial Court and two before this Court. Considering this aspect of the matter, petitioner is refrained from moving any further application for his bail. In case, same is moved, he will be burdened heavily with costs. Dismissed.
