PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.68 dated 06.09.2023 registered for the offences punishable under Sections 307, 324, 323, 341, 427, 148, 149 IPC and Section 27 of Arms Act, at Police Station Bhindi Saidan, District Amritsar.

Counsel for the petitioner submits that apart from the fact that the matter already stands compromised between the parties it is evident from the contents for the FIR that the petitioner was empty handed and has only been attributed lalkara. Cross case was registered after the petitioner suffered a gun-shot and remained hospitalized for 16 days. The petitioner has clean antecedents and has no other criminal record. 3.

Custody Certificate of the petitioner has been produced, which is taken on record. As per which the petitioner has undergone imprisonment of 1 month and 28 days.

State Counsel does not oppose the aforesaid factual assertions made by counsel for the petitioner which are based on record. 6.

I have heard counsel for the parties and have gone through records of the case.

Without commenting on the merits of the case and keeping in view the cumulative effect of the aforesaid facts i.e. the custody period already undergone, the compromise effected between the parties and the role attributed to the petitioner, the present petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
