ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.0242 dated 29.10.2018, registered under Sections 379-B of the Indian Penal Code at Police Station Sadar Khanna, District Khanna. The operative part of the order dated 07.01.2019, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Counsel for the petitioner has submitted that the recovery has already been effected from the co-accused of the petitioner namely Sukhbir Singh, who has been granted the concession of regular bail. It is further submitted that as per the allegations, the complainant - Kamaljit Kaur has stated in the FIR that she, later on, came to know the name of the driver of the motorcycle as petitioner - Rupinder Singh and other person as Sukhbir Singh, from whom the recovery was effected. Counsel for the petitioner has also submitted that the petitioner is not MOHD YAKUB 2019.03.14 16:29 I attest to the accuracy and integrity of this document

CRM-M No.64826 of 2018 involved in any other case. It is further argued that the petitioner was not known to the complainant and he is ready to join the investigation and co-operate throughout. Counsel for the State, on instructions from HC Jaswant Singh, has submitted that the petitioner be directed to join the investigation.

Counsel for the petitioner has submitted that, in pursuance to the order dated 07.01.2019, the petitioner has appeared before the Investigating Officer and has joined the investigation. Counsel for the State, on instructions from ASI Sharanjit Singh, has not disputed the aforesaid fact and submits that the petitioner is no more required for further investigation. In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 07.01.2019 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
