Prayer in the second petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.171 dated 04.09.2022 registered under Sections 22 of the NDPS Act, 1985 at Police Station Tibba, District Ludhiana.

Learned State counsel has produced the custody certificate dated 20.11.2023, as per which, the petitioner is behind bars for 01 year, 02 months and 16 days. The recovery effected from the petitioner is commercial in nature. He is involved in 02 other cases under the NDPS Act. The first bail application was withdrawn on 07.08.2023.

In view of the above, learned counsel for the petitioner prays for withdrawal of the present petition, at this stage. 4.
