DEEPAK GUPTA , J.(Oral) Petitioner is praying for grant of regular bail in case FIR No.383, dated 02.06.2021, registered at Police Station Sector 7, Faridabad, District Faridabad, under Section 22(c) of the Narcotic Drugs and Psychotropic Substances, Act, 1985.
Allegations are that 11 narcotic injections of buprenorphine with total quantity of 22 ml. was recovered from the possession of the petitioner on 02.06.2021. The commercial quantity starts from 20 ml. Thus the recovered quantity is just above the commercial quantity. Status report in the form of affidavit of Shri Munish Sehgal, Assistant Commissioner of Police, Ballabgarh, District Faridabad, has been placed on record by learned State counsel. As per the custody certificate placed on record by learned State counsel, petitioner is in custody for the last 1 year, 1 month and 14 days, though he is involved in one more case under Sections 323, 325/34 IPC which is not of the similar nature.
