Faced with the situation that all the prosecution witnesses have been examined, learned counsel for the petitioners seeks permission to withdraw the present petition at this stage with liberty to take all the pleas available to the petitioners at all relevant stages. However, learned counsel for the petitioners has submitted that the personal appearance of petitioner No. 1-Sushma Sharma be exempted.

The main petition is directed to be dismissed as withdrawn with liberty as aforesaid.

Keeping in view the fact that petitioner No. 1 is a lady aged about presently 69 years who is required to travel from Faridabad/Delhi to attend the trial proceedings at Tohaha, District Fatehabad, Haryana, petitioner No. 1 is PARVINDER SINGH 2024.05.21 16:22 I attest to the accuracy and integrity of this document chandigarh

CRM-M-58683 of 2022 granted exemption from personal appearance before the trial Court subject to the following conditions: - (i) she will be represented by a counsel;

(ii) she will not delay/stall the proceedings of the trial Court; (iii) she will not dispute her identity as accused; (iv) she will have no objection if the prosecution evidence is recorded in her absence but in presence of her counsel; (v) she will appear before the trial Court as and when required by the trial Court and any other condition which the trial Court may impose.

The petitioner shall file an affidavit before the concerned trial Court stipulating above conditions.
