(ORAL) The petitioners, through the instant petition are seeking modification of order dated 07.10.2022 whereby Additional Principal Judge Family Court, Sangrur has allowed interim maintenance of Rs. 10,000/- per month to petitioners i.e. Rs.6,000/- to petitioner No. 1wife and Rs. 4,000/- to petitioner No. 2-minor son of the respondent. The brief facts of the case are that marriage of petitioner No. 1 was solemnized with respondent on 08.02.2019 as per Hindu rites and rituals. The respondent after marriage got job in DC office, Sangrur. On 16.09.2019, the respondent left petitioner at her paternal home with an assurance that he will come back after normalization of his disputes with his mother.

The respondent did not come back to take away the petitioners, thus, the petitioners since then is staying at her parental home. The petitioner is blessed with a male child who at present is 21⁄2 years old. The petitioners preferred petition under PARAMJIT KAUR SAINI 2023.02.

CRR(F)-1335 of 2022 -2Section 125 Cr.P.C., before Family Court, Sangrur, seeking maintenance. The Family Court vide impugned order dated 07.10.2022 has awarded interim maintenance of Rs. 6,000/- per month to petitioner No. 1 and Rs. 4000/- per month to petitioner No. 2. The petitioners are further awarded Rs. 5500/- towards litigation expenses. Learned counsel for the petitioners, at the outset, submits that Family Court has determined interim maintenance of Rs. 10,000/- per month to the petitioners without appreciating earning of the respondent which indubitably is more than Rs. 45,000/- per month. The Family Court may be directed to expedite the determination of final maintenance.

I have heard counsel for the petitioners and perused the records.

The marriage of the petitioner with the respondent is undisputed. The respondent is working in D.C. Officer, Sangrur and getting salary. Petitioner No. 2 is minor son of the couple. Without commenting on merits of the case, the Family Court, Sangrur, is requested to expedite final determination of maintenance and preferably within three months from the date of receipt of certified copy of this order.
