**** KULDEEP TIWARI , J. (Oral) Through the instant petition filed under Section 439 Cr.P.C., the prayer is made for grant of regular bail to the petitioner in case FIR No. 50, dated 18.06.2023, under Sections 323, 324, 341, 506, 148, 149 IPC, (Section 326 IPC, added lateron) registered at Police Station Jodhan, District Ludhiana.

Learned counsel for the petitioner submits that the offences in the instant petition are triable by the Court of Judicial Magistrate Ist Class, and petitioner is behind the bars since 01.07.2023, the trial is at very initial stage, and the trial will take a long time to conclude. A perusal of the FIR reveals that the petitioner has given two 'Kirpan' blows to the injured on the forehead, which is grievous in nature.

Learned counsel for the petitioner relies upon the order passed by this Court on dated 07.11.2023, and submits that co-acused has GEETA RANI 2024.03.13 11:48 I attest to the accuracy and authenticity of this order/judgment

CRM-M-56327-2023 -22024:PHHC:033448 already been extended the benefit of regular bail. This Court, without commenting on the merits of the case, deem it fit and appropriate to extend the benefit of regular bail to the petitioner, considering the fact that Since the petitioner has already suffered incarceration of about more than 7 months, and trial is yet to begin, and all the offences are alleged to be triable by Magistrate, therefore, the present petition is allowed.

The petitioner is ordered to be released on bail on furnishing of bail bonds and surety bonds to the satisfaction of concerned Chief Judicial Magistrate/trial Court/Duty Magistrate. However, anything observed here-in-above shall have no effect on the merits of the case, and is meant for deciding the present petition only.
