(ORAL) In the present case, the petitioners have approached this Court with a prayer that the recovery done by the respondents in respect of amount paid to them as Leave Travel Concession is bad in law as the same has been done without issuing any show-cause notice and without giving any opportunity of hearing to them.
Counsel for the petitioners states that in the similar circumstances, this Court while deciding CWP No.23198 of 2015 titled 'Khazan Chand and others Vs. State of Punjab and others, decided on 06.10.2017, has already set aside the action of the respondent(s)-Bank in recovering the said amount. Petitioners claimed that they are simiarly situated as the petitioners in CWP No.23198 of 2015. CWP-31396-2018 -2served respondents with a legal notice on 23.10.2018 (Annexure P-11), which is still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice keeping in view the decision already rendered by this Court in CWP No.23198 of 2015, decided on 06.10.2017.
In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 23.10.2018 (Annexure P-11) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.
Present writ petition stands disposed of.
