In the present petition, the grievance being raised by the petitioner is that keeping in view the fact that the petitioner was already working at the time when New Pension Scheme was adopted on 01.01.2006, the petitioner is entitled for consideration of his claim under the Old Pension Scheme even if, the services of the petitioner were regularized after 01.01.2006. Reliance is placed upon the judgment passed in CWP-23712010, titled as 'Harbans Lal v. The State of Punjab and others', decided on 31.08.2010.

Learned counsel for the petitioner submits that the petitioner has already raised the said grievance in the representation dated nil (Annexure P10) but the same is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 6.
