Petitioner, an accused, in case FIR No.89 dated 07.06.2025 registered against him for commission of offence punishable under Section 5/13(2) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, at Police Station Bichhore, District Nuh, has filed the present petition for grant of pre-arrest bail.

On 08.09.2025, following order was passed by this Court:- "Petitioner, an accused, in case FIR No.89 dated 07.06.2025 registered against him for commission of offence punishable under Section 5/13(2) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, at Police Station Bichhore, District Nuh, has filed the present petition for grant of pre-arrest bail.

Learned counsel submits that petitioner has been falsely implicated in the present case. Hamid son of Rehmat, a covillager, who was nursing a grudge against petitioner and other accused gave false information against them that they are indulging in cow slaughter. Hamid only wanted to level scores with the accused. Taking his submissions further, learned counsel submits that relying upon the information given by Hamid, ASI Yashpal along with other police officials reached the site disclosed (house) where they found two oxen. At the said time, the house was in possession of Rashid and Nafish. Learned counsel submits that accused-Arman, has already been granted concession of interim bail by this Court vide order dated 19.08.2025 passed in CRM-M-44851-2025. He submits

that though the petitioner is involved in two other criminal cases of same nature, but he is on bail in both the said cases. Learned counsel submits that petitioner is ready and willing to join the investigation as and when called for by the Investigating Officer.

Notice of motion.

Ms. Shweta Nahata, DAG, Haryana, accepts notice on behalf of State of Haryana and seeks time to file detailed status report. Adjourned to 22.09.2025.

Needful be done well before the date fixed with an advance copy to the counsel opposite.

In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.)." 3.

Pursuant thereto, the status report by way of affidavit of Mr.Jitender Kumar, Deputy Superintendent of Police, Punhana has been placed on record. In para 8 thereof, it has been specifically mentioned that petitioner has joined the investigation on 10.09.2025 and the weapon of offence i.e. axe allegedly used by him has also been recovered. 4.

Submissions of both learned counsel heard. Documents perused.

Keeping in view the fact that petitioner has joined the investigation, recovery of weapon has already been effected, interim bail granted vide order dated 08.09.2025 is hereby confirmed, subject to conditions as envisaged under Section 482(2) BNSS. Further the petitioner is directed to join investigation as and when required in future by way of written notice for such purpose to be served by Investigating Officer of this case upon the petitioner; he will not tamper with the evidence nor will

influence the witnesses and will not leave the country without prior permission of the Court.

The petition stands allowed.
