Pending first appeal against judgment and decree passed by the trial Court, the application filed by the plaintiff to amend the plaint in order to incorporate the evidence in the pleadings has been dismissed. Order VI Rule 2 CPC provides that the pleadings are required to be confined to the material facts and that also in a precise and concise form. It is specifically provided that the evidence is not required to be a part of the pleadings. 2.
