The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.129 dated 12.09.2019 under Sections 306, 506, 201, 120-B IPC registered at Police Station Rajasansi, District Amritsar.

Learned counsel for the petitioner herein would contend that the petitioner has been falsely implicated and is in custody since 23.09.2019. It is further argued that marriage between the petitioner and the deceased was 22 years old and no complaint regarding any harassment had been made by the deceased in those 22 years. It is also argued that the complainant is not stepping forward to have his statement recorded and therefore, prays for grant of regular bail as the petitioner has to look after three children as there is no one to look after them. 3.

I have heard learned counsel for the parties. 5.

Since the investigation is complete and charges have been framed and the trial is likely to take some time to conclude as the complainant is not stepping forward to record his statement, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal bond and surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
