The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue his passport.

The petitioner was issued passport on 03.01.2013 which expired on 02.01.2023. An FIR No. 125 dated 04.05.2016, under Sections 148, 149, 365, 383, 447, 506 of IPC, came to be registered against the petitioner at Police Station Zirakpur, District SAS Nagar Mohali. The police after completing investigation has filed report under Section 173 Cr.P.C. The petitioner has filed CRM-M- 55556 of 2018 before this Court seeking quashing of FIR on merits. The petitioner preferred application before trial court seeking directions to respondents to re-issue his passport. The trial court vide order dated 06.12.2022 rejected application of the petitioner on PARAMJIT KAUR SAINI 2023.11.14 15:32 I attest to the accuracy and authenticity of this order/judgment

CWP No.25502 of 2023 -2- 2023:PHHC:144043 the ground that it is duty of the passport authority to renew the passport as per rules and trial court is not competent to issue any direction to the passport authority.

Learned counsel for the petitioner inter alia contends that as per instructions dated 14.03.2023 issued by Central Government, the respondents is supposed to consider application of the petitioner as proceedings have been stayed by High Court.

Faced with this, counsel for Union of India assures that Court that application of the petitioner would be considered and an appropriate order in terms of Government instructions shall be passed within six weeks from today.

In the wake of statement of learned counsel for Union of India, petition stands disposed of.
