*** HARSH BUNGER, J. (Oral) The present petition has been filed under Article 226 of the Constitution of India inter alia seeking a writ in the nature of Certiorari for quashing order dated 29.04.2022 (Annexure P-10) and order dated 09.11.2023 (Annexure P-12).

After arguing for some time, learned counsel for the petitioner prays that he may be permitted to withdraw the instant writ petition, however, appropriate directions be issued to the learned Commissioner, Rupnagar, Division Rupnagar to decide the remand case in a time bound manner.

On advance service of copy of petition, Mr. Navneet Singh, Senior D.A.G., Punjab, appears on behalf of respondent-State. 4.

Learned State counsel submits that the remand case is pending HIMANI GUPTA 2025.01.08 14:18 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh

CWP-28644-2024 (O&M) -2before the learned Commissioner, Rupnagar, Division Rupnagar for 31.01.2025. It is further submitted that in all probability the aforesaid remand case shall be decided by the concerned Officer/Authority on the date fixed i.e. 31.01.2025, and in any case, not beyond a period of two months thereafter.

Keeping in view the submissions made by learned counsel for the parties and without commenting on the merits of the case, the present writ petition is disposed of with a direction to respondent No.3 (Commissioner, Rupnagar Division, Rupnagar)/competent Authority to decide the remand case in pursuance of order dated 09.11.2023, passed by learned Financial Commissioner (Appeals), Punjab on the date fixed i.e. 31.01.2025, and in any case, not beyond a period of two months thereafter, by way of passing a speaking order and after affording due opportunity of hearing to all the concerned parties. 6.
