(Through Video-conferencing) ***** ARCHANA PURI, J. (Oral) Mr. Siddharth Sihag, Advocate has made appearance on behalf of the respondent and filed Power of Attorney, which is taken on record. Counsel for the respondent submits that he has no objection, if the transfer application is accepted and the petition under Section 13 of the Hindu Marriage Act is transferred from Kapurthala to Jalandhar. In view of the statement so made and from the contents of the application, it is evident that multiple litigation, mention whereof is given in the tabular form in paragraph No.1 of the application, between the parties, are pending at Family (Camp) Court, Bholath, District Kapurthala, but however, counsel submits that the divorce petition is pending at Kapurthala only.

TA-1155-2025 Also, it is evident from the application that one son born from the said wedlock, who is seven years old, is in the care and custody of the applicant. On query, it is also stated that the applicant is working as private teacher, though, this fact is not mentioned in the application. Considering the statement made by the counsel for the respondent and also considering the aforesaid factual position as well as the fact that the respondent is working at District Court, Kapurthala, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/166/2024, titled 'Rahul Behl Vs. Pachma Behl', filed by the respondent-husband, stands transferred from the Family Court, Kapurthala, to the Court of competent jurisdiction at Jalandhar.

The requisite record of the aforesaid case be sent by the Family Court, Kapurthala, to the District and Sessions Judge, Jalandhar. Learned District and Sessions Judge, Jalandhar, shall assign the said petition to the Family Court, Jalandhar. Even, the parties are directed to appear before the Family Court, Jalandhar, within a period of one month from today onwards.
