*** CRM-A-2721-MA-2018 Counsel for the complainant submits that he has a very good case on merit and there is sufficient evidence on record which is sufficient for convicƟon of the private respondents No.3 to 5 and convicƟon of respondent No.2 under SecƟon 302 IPC. There is no appreciaƟon of evidence in judgment dated 25.01.2016/04.02.2016. Counsel appearing for the private respondents oppose the prayer. Leave to appeal granted.

The accused i.e. private respondents No. 3 to 5 to execute a bond for aƩendance within two months, undertaking to appear in this Court, in case appeal is allowed. There is no need to furnish bonds by respondent No.2 as his appeal against convicƟon is already pending before this Court.

Given above, the accused i.e. private respondents No. 2 to 5 shall furnish a personal bond of Rs. Twenty Five Thousand only (INR 25,000/-), and furnishing one surety for Rs. Twenty Five thousand only (INR 25,000/-), to the saƟsfacƟon of the concerned Trial Court/Duty Magistrate. Before accepƟng the sureƟes, the concerned Court must saƟsfy that if the accused fails to appear in Court, then such surety is capable of producing them before the Court.

CRM-A-2721-MA-20181 -2The furnishing of the personal bonds shall be deemed acceptance of the all sƟpulaƟons, terms, and condiƟons of this order. In case of failure of private respondents No. 3 to 5 to furnish bond, the concerned Court shall proceed further in accordance with law.
