*** This petition for regular bail has been filed by petitioner Mamta Bajaj, an accused in F.I.R. No. 261 dated 27.9.2019 registered with Police Station Derabassi, District S.A.S. Nagar, Mohali for offences under Sections 3, 4, 5 of Immoral Traffic and Prevention Act, 1956. Briefly sated the facts of the case as per prosecution story are that F.I.R. in question was got registered at the instance of husband of petitioner-accused namely Tilak Raj Bajaj, inasmuch as he had stated that on 27.9.2019 when he came home, his daughter was crying loudly and told him that her mother (petitioner) used to send her for immoral work to different places. The complainant got his daughter admitted in Civil Hospital, Sector 6, Panchkula.

CRM-M No. 50445 of 2019 application for regular bail before Additional Sessions Judge, S.A.S.Nagar, Mohali but the same was dismissed vide order dated 5.11.2019, as such she has approached this Court for similar relief. The request is being opposed by the State counsel.

I have heard learned counsel for the petitioner and learned State counsel besides going through the record.

Although it is stated that the challan has been filed but charge has not yet been framed. The guilt of the accused shall be determined during the trial and its conclusion is likely to take some time. Considering all the facts and circumstances of the case, this petition is accepted. Petitioner Mamta Bajaj is ordered to be released on bail on her furnishing bail bond and surety bond to the satisfaction of the learned trial Court/CJM/Duty Magistrate, S.A.S. Nagar, Mohali. However, it is made clear that in case the petitioner is found indulging in any criminal act at a later stage, her order granting bail shall be liable to be withdrawn. (H.S.
