***** ARCHANA PURI, J. (Oral) At this stage, counsel for the applicant submits that she does not want to pursue with the transfer application and the same be dismissed as withdrawn.

However, counsel for the respondent has resisted the withdrawal of the application, as he submits that wrong facts have been given in the documents, annexed with the transfer application i.e. petition under Section 13-B of Hindu Marriage Act.

On query by the court, it is submitted that petition under Section 13-B of Hindu Marriage Act, was infact filed with the consent of both the parties and statements of first motion were recorded. However, at the time of statement of second motion, the applicant had withdrawn her consent, on account of which, petition under Section 13-B of Hindu Marriage Act, is still pending. Counsel submits that in the statement of first motion got recorded MAMTA 2024.12.16 16:52 I attest to the accuracy and integrity of this order/judgment

TA-1327-2024 (O&M) before the court, the version is different, as now pleaded in the transfer application.

Whatever it may be, it shall be seen by the court, where the said petition is pending by passing any effective order on the same. However, in view of the submission made by the counsel for the applicant, the present transfer application is hereby dismissed as withdrawn.
