#3# HARINDER SINGH SIDHU, J Since identical questions of law and facts are involved, all the aforesaid 13 petitions are being disposed of by this common order. Facts are being extracted from CRM-M-51244 of 2019. This petition has been filed under Section 482 Cr.P.C for quashing of order dated 06.11.2019 passed by learned Addl. Sessions Judge, Ludhiana in CRA No.2857 of 2019 whereby the sentence of the petitioner was suspended subject to deposit of 20% of the compensation amount. Respondent-complaint filed a complaint under Section 138 read with Section 142 of the Negotiable Instrument Act against the petitioner. Vide judgment/order dated 14.10.2019 passed by the learned trial Court, the petitioner was convicted and sentenced to undergo RI for two years with compensation having been awarded. The petitioner preferred an appeal against the said order before the learned Addl. Sessions Judge, Ludhiana. Learned Addl. Sessions Judge vide order dated 06.11.2019 suspended the sentence of the petitioner subject to deposit of 20% of the compensation amount.
Petitioner filed present petition impugning the aforesaid order vide which his suspension of sentence was made conditional on deposit of 20% of the compensation amount.
Vide order dated 03.12.2019, this Court while disposing of the petition modified order dated 06.11.2019 of the learned Addl. Sessions Judge to the extent that the suspension of sentence of the petitioner during the pendency of the appeal would not be revoked on his failure to deposit 20% of the compensation amount. Thereafter, the respondents filed an application for recalling of the said order.
#4# Vide order dated 13.05.2021, the application was allowed. Order dated 03.12.2019 was recalled and the main petition was directed to be listed as per roster.
Sh. Goel, learned counsel appearing for the respondents states that the amount as directed in the impugned order dated 06.11.2019 has already been deposited by the petitioner.
In view thereof, all present petitions have become infructuous and the same are disposed of as such.
