Petitioner !-"! +/$ 9 !"! +/$ has filed petition under Section Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.0102 dated 30.04.2024, under Sections 420, 406 of IPC, 1860, registered at Police Station Dasuya, District

 Hoshairpur (Annexure P-1). 2.

As per facts of the case, FIR has been registered on the written complaint filed by Simranjeet Kaur against M/s B.I.Nagar Immigration and Language School, Batala and Ravinder Kumar for committing fraud of Rs.23 lacs on the pretext of sending abroad. The complainant has given detail of amount deposited by her with accused No.1 from time to time. Later on the complainant along with her daughter visited the office of accused at Jalandhar, where it was informed that their Visa was refused. Later on a sum of Rs.5 lacs of GIC was received in the account of his daughter. Accused assured for Visa to U.K. The said amount was given towards part payment of fees for admission of his daughter. The complainant and his daughter went to Amritsar to make inquiry where they came to know that only Rs.5 lacs were received and the remaining amount of Rs.18 lacs was not deposited with the Embassy. Thereafter, they went to the office of accused No.1 which was lying closed. With these allegations, present FIR was registered. 3.

Learned counsel for petitioner argued that during the pendency of this bail application matter has been compromised with the complainant. Copy of compromise dated 12.12.2024 is Annexure P-3 and in pursuance of this compromise Rs.5 lacs have been returned. Petitioner is bound by the said compromise. Therefore, his anticipatory bail petition may be allowed. 4.

Mr. Bhrigu Dutt Sharma, Advocate appeared on behalf of complainant and filed power of attorney, which is taken on record. He confirmed the aforesaid compromise.

I have considered the arguments and have gone through the record carefully. As per the facts narrated in the FIR, complainant levelled specific serious allegations against petitioner for receiving huge amount for sending daughter of the complainant to foreign country but despite receiving huge amount neither the daughter of complainant was sent abroad and the amount given by complainant as college fees was also misappropriated. Now, the matter has been compromised and part payment has been received by complainant. Petitioner is ready to join the investigation. In the light of this, without going on the merits and considering the compromise already arrived at between the parties, anticipatory bail petition filed by petitioner is allowed. He be not arrested.

In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) BNSS. 7.

Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
