Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name & age of Petitioner (s) FIR No.

Allegations against the petitioner are that he supplied 28 kg of poppy-husk (14 kg each bag) to his co-accused, Santosh Rani, who happens to be none else than the real sister of the petitioner. Said co-accused Santosh Rani was never alleged to be involved in any other case under the NDPS Act. However, being a family member and present at the time of actual recovery, she was arrayed as an accused and subsequently arrested. Later on, she was released on regular bail by the learned Judge, Special Court, Fazilka, vide order dated 20.05.2025.

On the other hand, it is noticed that the petitioner is already involved in about 22 other criminal cases, out of which 9 cases are under the NDPS Act.

Faced with this situation, learned counsel for the petitioner prays for withdrawal of the instant anticipatory bail petition, while submitting that the petitioner is ready to surrender before the concerned Court within two weeks from today. He, however, seeks a time-bound direction to the Court below for deciding the application for regular bail, which would be filed by the petitioner after his surrender. 5.
In view of the above, the prayer made by learned counsel for the petitioner is accepted.

The petition is dismissed as withdrawn. It is, however, observed that in case petitioner surrenders before the Court below within a period of two weeks from today and thereafter moves an application for regular bail, the same shall be finally decided, in accordance with law, by the Court below within a period of two weeks thereafter.
