Mr. Amit Rana, Senior Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Petitioners are seeking the concession of anticipatory bail in FIR No.138 dated 19.08.2024 under Sections 406, 420, 506, 120-B of the IPC registered at Police Station Salem Tabri, Police Commissionerate Ludhiana.

Vide order dated 23.10.2024, the petitioners had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel inter alia contends that the dispute, if any, between the parties is essentially of a civil nature; the petitioners subsequent to the execution of agreement to sell in question, had gone to the office of Sub Registrar on the target date i.e. 15.05.2024 and got their presence marked, however, it was the complainant who failed to come on the target date. CRM-M-52874-2024 -2required and furthermore, they are willing to join investigation and cooperate with the Investigating Agency.
On a pointed query posed to the learned counsel as to whether the petitioners have previously been involved in any other criminal case, he has categorically replied in the negative."

Learned counsel for the petitioners submits that in compliance of order dated 23.10.2024, the petitioners have joined investigation and cooperated with the investigating agency. 4.
Learned State counsel, on instructions from ASI Harmesh Lal, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioners are not required for further investigation much less for their custodial interrogation. 5.
In view of the above, the petition is allowed and interim order dated 23.10.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
