PANKAJ JAIN, J. (ORAL) Present petition is directed against the order dated 20th of October, 2023 whereby the bail bonds and surety bonds furnished by the petitioner have been ordered to be cancelled and forfeited to the State. 2.

The petitioner has been summoned to face trial for offence punishable under Section 138 of the Negotiable Instruments Act, on the complaint made by respondent No.2 vide order dated 21st of February, 2022. From the records it is discernible that the petitioner appeared before the Trial Court and was admitted to bail. However, at the stage of crossexamination firstly on 29th of September, 2023 the petitioner moved an application seeking exemption from personal appearance and thereafter on 23rd of October, 2023 absented himself leading to passing of the impugned order.

In the peculiar facts and circumstances of the present case, the instant petition is disposed off with the direction to the petitioner to appear before the Trial Court on or before 30th of November, 2023. 6.

In case, the petitioner appears and surrenders before the Trial Court bail bonds/surety bonds already furnished by him shall be ordered to be revived.

Ordered accordingly.
