DEEPAK GUPTA , J.(Oral) Status report by way of affidavit of Shri Aaswant Singh, Deputy Superintendent of Police, Sub Div. Faridkot, District Faridkot along with custody certificate, has been filed on behalf of respondentState. By way of present petition filed under Section 439 Cr.P.C., prayer is made for grant to regular bail in case FIR No.39 dated 28.05.2023, under Sections 307, 324, 148, 149 and 506 of IPC (Section 326 IPC added later on), registered at Police Station Sadiq Faridkot, District Faridkot.
After arguing for some time, statement is made by learned counsel for the petitioners qua petitioner No.2-Mahinder Singh, so as to withdraw this petition at this stage with liberty to move fresh petition after recording the statement of injured during trial. As such, present petition qua petitioner No.2-Mahinder Singh is dismissed as withdrawn with the liberty as prayed for. As far as case of petitioner No.1-Harjinder Singh @ Soni is concerned, it is contended that his role is on parity with co-accused Manjit Kaur, who has already been granted the benefit of regular bail by this Court vide order dated 28.08.2023 passed in CRM-M-41553-2023, SARITA RANI 2023.12.06 17:33 I attest to the accuracy and integrity of this document/order
CRM-M-56740-2023 - 2 - copy of which is annexed with the petition as Annexure P-2, inasmuch as only presence of the petitioner was there without any active participation. Learned State counsel does not dispute the aforesaid factual position.
In view of the above circumstances and on the basis of parity, but without commenting anything on the merits of the case, petitioner No.1-Harjinder Singh @ Soni is admitted to bail. He is ordered to be released on bail on his furnishing requisite bail bonds and surety bonds to the satisfaction of learned Trial Court/Duty Magistrate concerned. Allowed qua petitioner No.1-Harjinder Singh @ Soni only and dismissed as withdrawn with the liberty as prayed for qua petitioner No.2-Mahinder Singh.
