SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.238 dated 04.07.2018 registered under Sections 148, 149, 323, 325 and 506 of Indian Penal Code, 1860 at Police Station Nissing, Karnal.

On 28.11.2019, this Court passed the following order:- Learned counsel for the petitioner submits that learned Court below has declined the anticipatory bail to the petitioner on the ground that other two FIRs are pending against him. In fact, in both these FIRs,petitioner has been found innocent. The offences in this case are punishable under Sections 148, 149, SAVITA KADIAN 2021.07.14 16:22 I attest to the accuracy and integrity of this document High Court Chandigarh

Notice of motion for 17.03.2020.

Petitioner is directed to surrender before the police and join investigation within two weeks. In the event of his arrest being required, he shall be released on interim bail till the next date, subject to his furnishing bonds to the satisfaction of Arresting Officer. However, he shall abide by the terms and conditions as envisaged under Section 438(2)(i) to (iv) Cr.P.C. failing which he shall loose the benefit of interim bail allowed to him" Learned State counsel, on instructions from SI Bal Kishan submits that the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 28.11.2019 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
