Mr. Mukesh Bhatnagar, Advocate for the complainant. *** The case has been taken up through Video Conferencing. As per report received from the Child Welfare Committee, Chandigarh, the alleged detenue Usha has been admitted in Snehalaya, Chandigarh under orders of this Court passed in this case, she has delivered a baby girl on 7.4.2020, during counseling Usha has stated that she wants to go back home with her parents.

The instant criminal writ petition was filed by Sh. Ranjan Lakhanpal, Advocate, a human rights activist, on receipt of letter from Usha Kumari alleging that she being a minor had been married with Ranjit Kumar by her parents, who was maltreating her and she had been turned out of her matrimonial home, her parents had also refused to accept here back in their house. She had requested for being freed from the clutches of her in-laws and parents.

CRWP No. 1174 of 2019 On filing of the petition notice of motion was issued. The alleged detenue was produced in the Court and she was ordered to be sent to Aashiana in Sector 15, Chandigarh.

Under the circumstances, since the girl in question is not in illegal custody, the present criminal writ petition is disposed of with the observation that the concerned trial Court where the challan with regard to F.I.R. No. 31 dated 18.2.2020 has been filed, shall pass appropriate order in that regard in accordance with law keeping in view the facts and circumstances of the case and the interest, safety and welfare of the minor girl. Till then Usha along with her new born daughter shall remain at Snehalaya, Chandigarh.
