RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of direction to decide the appeal filed by the petitioner on 24.04.2023 before the Financial Commissioner Punjab, Rural Development and Panchayat Department (Exercising the power of State). It is further prayed to stay operation of the impugned order, dated 22.03.2023, Annexure P-1, vide which petitioner has been suspended from the post of Panch till the pendency of the writ petition.

It has been fairly submitted by learned counsel for the petitioner that the petitioner challenged his suspension order dated 22.03.2023 by way of filing an appeal before respondent No.1. He submits that the appeal was filed alongwith the stay application, however, till date no hearing has taken place on the same. He submits that if appeal alongwith the stay application is not heard, the petitioner would suffer an irreparable loss and injury. Notice of motion.

After hearing learned counsel for the parties, the present petition is disposed of with a direction to respondent No.1-Financial Commissioner, Rural Development and Panchayat Department Chandigarh, to take up the appeal alongwith the stay application and decide the stay application expeditiously in accordance with law after hearing counsel for the parties.

Impugned order dated 24.04.2023 challenged in the appeal shall remain stayed till the disposal of the stay application pending alongwith appeal before respondent No.1.
