The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 12.10.2023 (Annexure P-9/A) whereby passport of the petitioner has been revoked. 2.
Learned counsel for Union of India, who on advance notice is present in Court, at the outset, submits that impugned order is an appealable order and if petitioner files appeal within a week from today, the appellate authority would decide appeal on merits.

Faced with this, counsel for the petitioner seeks permission to withdraw the instant petition with liberty to file appeal, however, he prays that the appellate authority may be directed to decide the appeal in a time bound manner.
