The present appeal has been filed by the appellants/accused persons against the order dated 18.10.2024 passed by the Court of Additional Sessions Judge, SBS Nagar vide which the application filed by the appellants under Section 482 of BNSS, 2023 seeking grant of anticipatory bail in criminal case having FIR No.101, dated 26.09.2024, registered under Sections 115(2), 191(3), 190 of BNS, 2023 and Section 3(1)(XIV) & 3(1)(XV) of SC & ST Act, at Police Station Kathgarh, has been dismissed.

On the last date of hearing, this Court has observed that as far as the assault is concerned, only simple injuries are attributed to the Priyanka Thakur 2024.12.13 17:32 I attest to the accuracy and integrity of this document
CRA-S-3479-2024 -2appellants. Regarding the offence punishable under SC & ST Act, there are no specific allegations and it is simply recorded in the FIR that the appellants used derogatory words against the caste of the complainant and resultantly, this Court passed order granting interim bail to the appellants with a direction to join the investigation with the Police. The said interim order was passed in presence of the counsel appearing on behalf of the complainant.

Today, counsel appearing on behalf of the appellants apprised the Court that in compliance of the previous order, the appellants have joined the investigation with the Police.

Learned State counsel on instructions from DSP Sham Sunder has not refuted the aforesaid assertions made by the counsel for the appellants and further submits that the appellants are not required by the Police for further investigation or custodial interrogation. 5.
In view of the above, without commenting on the merits of the case, the present appeal is hereby allowed and order of interim bail dated 29.10.2024 is hereby made absolute subject to the conditions as envisaged under Section 482(2) of BNSS, 2023.
