The petitioner seeks quashing of DDR No.14, dated 11.7.2017 registered at Police Station Dorangla, District Gurdaspur under Sections 326, 324, 323, 148, 149 of Indian Penal Code in FIR No.10, dated 3.3.2017 registered at Police Station Dorangla, District Gurdaspur, under Sections 324, 323, 148, 149 of Indian Penal Code and all subsequent proceedings emanating therefrom on the basis of a compromise stated to have been effected between the parties.

Vide orders dated 28.7.2023/15.11.2023, the parties had been directed to appear before the Illaqa Magistrate/Trial Court so as to get their statements recorded qua the factum of compromise.

Report of learned Judicial Magistrate 1st Class, Gurdaspur has been received, wherein it has been reported that statements of petitioner/accused Khushal Pankaj Kakkar 2024.02.28 14:17 I attest to the accuracy and authenticity of this document
CRM-M-54666-2018 (O&M) ( 2 ) 2024:PHHC:027464 Singh and also of respondents No.2 to 4 namely Lakhwinder Singh, Jaswinder Singh and Sukhjinder Singh have been recorded to the effect that they have compromised the matter amongst themselves. 4.
Respondents No.2 to 4 namely Lakhwinder Singh, Jaswinder Singh and Sukhjinder Singh in their statements have stated that they have no objection in case the FIR in question is quashed.

Learned Judicial Magistrate 1st Class, Gurdaspur has specifically opined that the parties have entered into compromise voluntarily and without any undue influence.

In view of the aforesaid compromise and bearing in mind the law laid down by Full Bench of this Court in 2007(3) RCR (Crl.) 1052 Kulwinder Singh and others Vs. State of Punjab, the present petition is allowed and DDR No.14, dated 11.7.2017 registered at Police Station Dorangla, District Gurdaspur under Sections 326, 324, 323, 148, 149 of Indian Penal Code in FIR No.10, dated 3.3.2017 registered at Police Station Dorangla, District Gurdaspur, under Sections 324, 323, 148, 149 of Indian Penal Code and all subsequent proceedings emanating therefrom are hereby quashed qua petitioner.
