(ORAL) Challenge in the present petition is to the impugned order dated nil (Annexure P-10) passed by respondent No.2- District Registrar, Firms and Societies, Kurukshetra as well as to the order passed in the petition filed by only three members out of 1000 members just to delay the election process. Learned counsel for the petitioner contends that the District Registrar, Firm and Societies, Kurukshetra has passed the impugned order without giving any particulars about the matter as well as the date of passing of the order. So much so, he has not even mentioned about the next date of hearing in the matter. In an arbitrary and whimsical manner, the impugned order has been passed directing the elections of the petitioner Sabha to be kept in abeyance. He is, however, not in a position to dispute that under Section 79 of RAJENDER KUMAR 2024.11.05 06:20 I attest to the accuracy and integrity of this document

CWP-28823-2024 -2the Haryana Registration and Regulation of Societies Act, 2012, there is a statutory remedy of appeal before the State Registrar of Firms and Societies, Haryana against an order passed by the District Registrar of Firm and Societies. In view of the above, he does not press the instant petition and seeks withdrawal of the same at this stage with liberty to approach the State Registrar, Firms and Societies, Haryana by way of filing a statutory appeal against the impugned order. He, however, submits that the State Registrar of Firms and Societies, Haryana may be directed to decide the appeal in a time bound manner.

I find that the aforesaid prayer is acceptable. The present petition is accordingly disposed of as withdrawn at this stage with liberty to the petitioner to file an appeal before the State Registrar of Firms and Societies, Haryana.

Needless to mention that in the event of the petitioner filing an appeal before the State Registrar of Firms and Societies, Haryana, it shall take an expeditious decision and prayer for an interim order shall be considered expeditiously and preferably within a period of 15 days of filing of such appeal alongwith an appropriate application, after granting an opportunity of hearing to the respective parties.

Disposed of accordingly.
