The present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.31 dated 30.01.2017, registered under Sections 420 and 177 IPC, at Police Station Division 1, District Ludhiana. 2.

Learned counsel for respondent No.2 has brought to the notice of this Court that during the pendency of the present petition, an application for discharge had been filed by the petitioner, which came to be dismissed by the trial Court vide order dated 06.03.2023 and even the charges stand framed. 3.

Faced with this, learned counsel for the petitioner prays for withdrawal of the instant petition to challenge the aforesaid order. He, however, prays that the trial Court be directed to grant exemption to the petitioner from personal appearance, as he is a senior citizen and has now retired from the post of Chief Manager in Central Bank of India. He is ready to furnish an undertaking by way of affidavit to appear before the trial Court on the dates, for which his MOHIT 2023.08.08 17:48 I attest to the accuracy and authenticity of this order/judgment

Dismissed as withdrawn.

However, if the petitioner files an application for grant of exemption from personal appearance, the same shall be considered, in accordance with law, keeping in view the aforesaid facts.
